Terms of Service

These terms govern use of HermesBackup. By creating an account or using the service, you agree to them. You must be at least 18 years old and able to enter a binding agreement.

The zero-knowledge contract

You encrypt backup data on your machine before upload and you control the private recovery key. HermesBackup does not receive plaintext backup data and cannot decrypt stored ciphertext. You are responsible for saving the recovery key off-machine. If you lose every copy, your backups are permanently inaccessible and support cannot recover them.

Accounts and devices

You are responsible for account credentials and paired-device tokens. A valid device token can initiate, list, download, or delete backups for its account. Revoke lost or untrusted devices promptly. Revoking a device does not delete existing backups.

Plans, quotas, and billing

The Free plan includes 2 GiB, 60 stored objects, and four uploads per day. Pro includes 10 GiB, 500 stored objects, and 24 uploads per day for $10 per year. Stripe processes payments. Subscriptions renew annually until canceled. Cancellation downgrades the account at the end of the paid period; if usage exceeds the Free limit, existing backups remain available but new uploads may be blocked until usage is reduced or Pro is restored.

The server never silently deletes data to make quota space. If storage is full, the API returns HTTP 507. Deletion or rotation occurs only through an authenticated user or a client policy the user enabled.

Acceptable use

Do not use the service to violate law, infringe rights, attack systems, evade quotas, distribute malware, or operate generic public file hosting. Do not attempt to access another account, probe credentials, or interfere with service availability.

Availability and backups

We work to provide reliable storage and recovery, but no service can guarantee uninterrupted availability or prevent every loss. Maintain your recovery key and, where appropriate, an additional independent copy. Test restores periodically. The service is provided “as is” to the extent permitted by law.

Deletion and termination

You may delete backups or close your account from the dashboard. We may suspend accounts for security threats, abuse, nonpayment, or legal requirements. Account closure deletes stored objects and account-owned operational records subject to short dispute tombstones and legally required billing or fraud records.

Liability

To the maximum extent permitted by law, HermesBackup is not liable for indirect, incidental, special, consequential, or punitive damages, including loss caused by a lost recovery key. Aggregate liability for a paid account is limited to fees paid for the service during the twelve months before the claim. Some jurisdictions do not allow all limitations, so mandatory rights still apply.
